Terms and Conditions

KA Preps (Astrykx Private Limited) provides educational and academic-support services, including, without limitation:

• One-to-one online tutoring;
• Academic counselling and educational guidance;
• Trial classes;
• Academic assessments and progress tracking;
• Examination preparation;
• Cambridge, IGCSE, IB, AP, SAT and other international-curriculum support;
• Academic resources and learning materials;
• Profile-building guidance and opportunities;
• School-selection guidance;
• University and study-abroad guidance;
• Educational recommendations;
• Parent dashboards and academic progress tools;
• Educator and mentor services;
• Technology-enabled academic recommendations;
• AI-assisted communication, scheduling, recommendations and counselling;
• Other educational services introduced from time to time;

KA Preps may add, modify, suspend or discontinue any Service or feature at any time.

The Services may be used by parents, guardians, students, educators and other authorised users.

Where a student is a minor, the parent or legal guardian:

• confirms that they are legally authorised to act on behalf of the student;
• consents to the student's participation in the relevant Services;
• accepts these Terms on behalf of the student where legally required;
• is responsible for supervising the student's use of the Services where appropriate;
• is responsible for ensuring that information supplied to KA Preps regarding the student is accurate;

KA Preps may require additional parental or guardian verification where required by applicable law or where the nature of the Service requires it.

Certain Services may require you to create an account.

You agree to provide accurate, current and complete information and to update such information where necessary.

You are responsible for:

• maintaining the confidentiality of your account credentials;
• all activity occurring through your account;
• notifying KA Preps promptly of unauthorised access;
• ensuring that account information remains accurate;

You must not create an account using another person's identity or impersonate another person.

KA Preps may suspend or terminate an account where information provided is materially false, misleading, fraudulent or otherwise inconsistent with these Terms.

KA Preps provides educational support and does not guarantee a particular academic result, examination grade, admission outcome, scholarship, university acceptance or career outcome.

Academic outcomes may depend on numerous factors, including:

• student's existing academic level;
• attendance;
• effort and participation;
• school teaching;
• examination difficulty;
• examination-board requirements;
• preparation time;
• educator suitability;
• quality and completeness of information provided;
• external circumstances;
• factors outside KA Preps' reasonable control;

Any references to “A*”, “grade improvement”, “transformation”, “success”, “outcomes” or similar language describe the intended educational objective and do not constitute a guarantee of a particular result.

KA Preps may connect students with independent educators, tutors, mentors or academic specialists.

Educator allocation may be based on factors including:

• curriculum;
• subject;
• academic level;
• availability;
• experience;
• qualifications;
• certifications;
• teaching history;
• student requirements;
• operational considerations;

KA Preps may change an educator where reasonably necessary.

Where a tutor-rematching facility is offered, the applicable rematching terms communicated at the time of enrolment shall apply.

KA Preps does not guarantee that a particular educator will remain available throughout the entire duration of a programme.

Where a free or paid trial class is offered:

• the trial is subject to availability;
• trial availability may vary;
• trial slots are not guaranteed until confirmed;
• students and parents are expected to attend confirmed sessions punctually;
• repeated cancellations, non-attendance or unreasonable rescheduling may affect future trial availability;

A trial class is intended to allow the student and parent to assess suitability and does not itself constitute an obligation to purchase a programme unless expressly stated otherwise.

Fees, package structures, session duration, validity periods and applicable taxes will be communicated through the website, application, quotation, invoice or other official KA Preps communication.

Unless expressly stated otherwise, fees are exclusive of applicable taxes where required by law.

Current packages may include:

• 10 Hours — INR 25,000;
• 20 Hours — INR 50,000;
• 40 Hours — INR 1,00,000;

KA Preps reserves the right to revise pricing for future purchases.

The price applicable to an order is the price displayed or communicated at the time of purchase, subject to applicable taxes and payment terms.

Payments may be processed through third-party payment providers.

KA Preps does not ordinarily store complete payment-card information on its own systems where payment processing is handled by a third-party payment processor.

You agree to provide accurate billing and payment information.

A transaction may be rejected, reversed or delayed for reasons including payment-provider restrictions, fraud checks, technical failures or regulatory requirements.

The cancellation, rescheduling and refund terms applicable to a particular programme will be communicated at the time of purchase or enrolment.

Where no specific programme-level policy is provided, refunds will be considered in accordance with:

• applicable law;
• services already delivered;
• administrative/payment-processing charges where legally permissible;
• the nature of the package purchased;
• the circumstances of the request;

KA Preps will not impose a contractual restriction that is inconsistent with mandatory consumer-protection law.

All KA Preps content, including:

• notes;
• worksheets;
• frameworks;
• teaching methodologies;
• videos;
• recordings;
• presentations;
• assessments;
• question banks;
• templates;
• written materials;
• graphics;
• software;
• application interfaces;
• website content;
• logos;
• trademarks;
• branding;
• proprietary educational systems;

are owned by or licensed to KA Preps unless otherwise stated.

You receive a limited, non-exclusive, non-transferable, revocable right to use such materials solely for personal educational purposes.

You must not:

• reproduce;
• sell;
• sublicense;
• distribute;
• publish;
• upload;
• commercially exploit;
• reverse engineer;
• scrape;
• reproduce for another educational business;
• create derivative commercial products;

from KA Preps proprietary materials without prior written permission.

Students or parents may submit:

• answer scripts;
• assignments;
• essays;
• academic records;
• school reports;
• examination results;
• project work;
• photographs or scans;
• educational documents;
• other materials;

for the purpose of providing Services.

You represent that you have the right to provide such materials.

KA Preps may use submitted materials for providing, evaluating and improving the relevant Services, subject to the Privacy Policy and applicable law.

KA Preps will not publicly display identifiable student work for marketing purposes without appropriate permission where required.

KA Preps may use artificial intelligence and automated technologies for purposes including:

• lead qualification;
• appointment scheduling;
• academic information collection;
• communication;
• recommendations;
• reminders;
• customer support;
• administrative workflows;
• educational personalisation;
• analysis of information supplied by users;

AI-generated recommendations are intended to assist human decision-making and should not be treated as a substitute for professional human judgement.

Where a material decision affecting a student or user is made using automated systems, KA Preps will take reasonable steps appropriate to the circumstances and applicable law.

Users should not submit highly sensitive information to an AI system unless KA Preps specifically requests it for a legitimate purpose.

The Services may integrate with third-party services including:

• payment providers;
• communication providers;
• cloud-storage providers;
• analytics providers;
• CRM systems;
• scheduling systems;
• AI providers;
• video-conferencing platforms;
• educational technology providers;
• authentication providers;
• other service providers;

Use of such services may be subject to their respective terms and privacy policies.

KA Preps is not responsible for independent third-party services that are outside its reasonable control.

You agree not to:

• misuse the Services;
• interfere with the operation of the website or application;
• attempt unauthorised access;
• introduce malicious software;
• scrape or systematically extract data;
• reverse engineer the application;
• circumvent security controls;
• impersonate another person;
• upload unlawful, abusive, defamatory or infringing material;
• use the Services to harass educators, students, employees or other users;
• misuse another person's personal information;
• use KA Preps Services for unlawful or fraudulent purposes;

KA Preps may suspend access where reasonably necessary to protect users, systems, intellectual property or legal rights.

KA Preps recognises that many users of its educational Services are children and teenagers.

We seek to design our Services with appropriate safeguards for minors.

Where required, parental or guardian involvement and consent will be obtained.

KA Preps educators and staff are expected to maintain appropriate professional boundaries with students.

Users must not use KA Preps Services to engage in inappropriate, exploitative, abusive or unsafe conduct involving a minor.

Concerns relating to child safety should be reported immediately through the contact details provided in these Terms or the application.

Your use of the Services is also governed by the KA Preps Privacy Policy.

The Privacy Policy explains:

• what information we collect;
• why we collect it;
• how we use it;
• when we share it;
• how long we retain it;
• how we protect it;
• how users may exercise applicable privacy rights;
• how we handle children's information;

The Privacy Policy forms part of these Terms.

By using the Services, you may receive service-related communications including:

• account notifications;
• trial confirmations;
• appointment reminders;
• payment notifications;
• academic updates;
• support communications;
• security notifications;
• other transactional messages;

Where legally permitted, you may separately choose whether to receive promotional communications.

Unsubscribing from marketing communications does not necessarily stop essential service-related communications.

KA Preps aims to maintain reliable Services but does not guarantee that the website, application or any particular feature will always be:

• available;
• uninterrupted;
• error-free;
• secure against every possible threat;
• compatible with every device or operating system;

Maintenance, updates, technical failures, third-party outages and circumstances beyond our reasonable control may temporarily affect availability.

The Services are provided for educational and informational purposes.

Except where expressly required by applicable law, KA Preps does not guarantee:

• a particular examination result;
• a particular grade;
• admission to a particular school or university;
• scholarship or funding;
• employment;
• immigration or visa approval;
• commercial success;
• uninterrupted access to the Services;
• complete accuracy of third-party information;

Users remain responsible for independently verifying important academic, admissions, financial, immigration or legal information before making decisions.

To the maximum extent permitted by applicable law, KA Preps shall not be liable for indirect, incidental, consequential, special or unforeseeable losses arising from the use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct, or statutory consumer rights.

Where permitted by applicable law, KA Preps' aggregate liability in connection with a particular paid Service shall not exceed the amount actually paid by the user for that Service during the applicable period.

This limitation does not apply where prohibited by applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold KA Preps, its directors, employees, educators and service providers harmless from claims, losses or expenses arising from:

• your material breach of these Terms;
• unlawful use of the Services;
• infringement of third-party rights;
• fraudulent activity;
• misuse of another person's account or information;

KA Preps may suspend or terminate access where:

• these Terms are materially breached;
• payment obligations are not met;
• fraudulent activity is suspected;
• security is compromised;
• misuse of the Services occurs;
• required by law;
• necessary to protect users or KA Preps;

KA Preps may update these Terms from time to time.

Material changes will be communicated through appropriate channels where required by law.

Continued use of the Services after the effective date of updated Terms constitutes acceptance where legally permitted.

These Terms shall be governed by the laws of India.

Subject to applicable consumer-protection and mandatory laws applicable to a user in another jurisdiction, courts having jurisdiction over Pune, Maharashtra, India shall have jurisdiction over disputes arising from these Terms.

Nothing in this clause is intended to remove any mandatory legal right available to a consumer under the laws applicable to that consumer.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

These Terms, together with the Privacy Policy and any programme-specific terms communicated to you, constitute the agreement governing your use of the Services.
